In this video, Sabrina Layman explains the circumstances in which spousal maintenance (sometimes called spousal support or alimony) may be awarded in Washington State.
Spousal maintenance is a tool the court uses to balance assets, debts, and financial outcomes during a divorce. While there is no strict formula, a guideline sometimes referenced suggests about one year of support for every three to five years of marriage. Shorter marriages where both spouses work may not involve spousal maintenance, while longer marriages or those with significant financial resources, such as investments or real estate, may use it to bridge financial gaps.
Ultimately, the key questions are: Does one spouse need support, and does the other have the ability to pay? Other factors may be considered under Washington law, but the focus is on ensuring fairness and helping both parties transition from the start of divorce to its resolution.
