In this video, Sabrina Layman explains how courts in Washington State determine child custody during a divorce.
The law outlines many factors the court must consider, starting with what arrangement would be the least disruptive for the children. Judges look closely at each family’s circumstances, including where the parents live, the children’s ages, school and extracurricular schedules, and the parents’ work commitments.
Above all, the court is required to focus on the best interests of the children. Because custody cases often involve strong emotions and conflicting views, a guardian ad litem may sometimes be appointed. This court-appointed advocate interviews parents, children (when appropriate), and others involved to provide recommendations to the court.
Ultimately, custody decisions are made by the judge, who weighs all of the evidence and perspectives to determine what is best for the children.
